§ 1. General provisions
1. These regulations (hereinafter referred to as the “Regulations”) define the rules of use of the Omenaa Foundation website (hereinafter referred to as the “Website”), available at:
https://rioeducentrum.com.
2. The entity operating the Website is Omenaa Foundation with its registered office in Warsaw at Heleny Kozłowskiej Street No. 1 apt. 43, 00-710 Warsaw, entered into the register of associations, other social and professional organizations, foundations and independent public healthcare facilities of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under the KRS number:
0000509539, Tax Identification Number (NIP): 5272719133, National Business Registry Number (REGON): 147357946 (hereinafter referred to as the “Foundation”).
3. A user of the Website (hereinafter referred to as the “User”) is any person who uses it.
4. The Website operates based on “cookie” technology. The principles of using “cookies” by the Foundation are contained in the Privacy Policy available at:

5. The Foundation may also process the personal data of Website Users. The principles of processing personal data by the Foundation can be found at:

6. All rights to the Website, including intellectual property rights to its name, internet domain, as well as to templates, forms, logos, banners, and images posted on the Website, belong to or are vested in the Foundation. Any materials made available through the Website may not be reproduced or distributed in any form or by any means in any field of use, including copying, photocopying, and digitization, including posting on the internet, without the Foundation’s written consent, with the exception of materials marked “Downloadable,” which may be downloaded and used legally. The use of trademarks or graphic works covered by copyright belonging to the Foundation without the Foundation’s consent is prohibited.
7. Each Website User may contact the Foundation by sending electronic correspondence to the following email address: [email protected] or by traditional mail to the Foundation’s registered office.
§ 2. Terms of Service
1. The User using the Website is obliged to read these Regulations and comply with their provisions. Using the Website constitutes acceptance of these Regulations.
2. Using the Website is free of charge and does not require registration.
3. The User bears the costs of connecting to the Website, in accordance with the price list of the telecommunications operator serving them.
4. Through the Website, the Foundation enables the User to use the following services:
a) reading the content provided by the Foundation, in particular those related to its statutory activities and current aid campaigns for those in need;
b) contacting the Foundation.
5. The Foundation is not an entity providing payment services.
6. The Foundation provides on the Website an up-to-date list of methods enabling payments to the Foundation in order to support its statutory activities promoted through the Website.
7. In order for Users to properly use the services available on the Website, the following are necessary:
a) an Internet connection;
b) possession of devices enabling the use of Internet resources;
c) using a web browser that enables the display of hypertext documents linked on the Internet via a web service and that supports the JavaScript programming language, and that also accepts cookies.
8. The Foundation points out that use of the Website depends on the properties of the Internet network and the User’s computer equipment, over which the Foundation has no influence.
9. The Foundation is not responsible for any disruptions in the use of the Website, including interruptions in the functioning of the Website caused by force majeure, unauthorized actions of third parties, or incompatibility of the website with the technical infrastructure of those using or attempting to use the Website.
10. The Foundation is not responsible for the blocking of email transmissions (or deletion of emails) by email server administrators or by software installed on the computer of the person using the Website, including anti-spam filters.
11. It is prohibited to post illegal content on the Website, in particular content inciting racial, ethnic, religious or sexual orientation hatred, containing pornographic content, praising fascism, Nazism, communism, promoting violence, offending religious feelings, violating the rights of other people, including in particular their personal rights.
12. If the Foundation becomes aware that a User has posted illegal content on the Website, it will immediately block access to it. If access to published content is unjustly blocked, please contact us at [email protected] within 7 days of the blocking date. After this period, the published content may be irrevocably deleted by the Foundation.
13. Users of the Website post all content and comments on their own behalf and at their sole risk.
§ 3. Conditions for concluding and terminating agreements for the provision of electronic services
1. The agreement for the provision of electronic services is concluded for an indefinite period and may be terminated by the User or the Foundation under the terms specified below. The agreement for the provision of electronic services is deemed concluded upon the commencement of use of the Website by the User.
2. The User, without giving a reason, is entitled to terminate the agreement for the provision of electronic services at any time, with immediate effect.
3. Termination of the agreement for the provision of electronic services by the User may occur in any manner, in particular by:
a) ceasing to use the Website;
b) sending a written declaration to the Foundation’s registered office address or to the Foundation’s e-mail address indicated in § 1, section 7 of the Regulations.
4. The Foundation is liable for non-performance or improper performance of the services covered by the agreement with the User in accordance with generally applicable law.
§ 4. Complaints
1. Every User has the right to file a complaint regarding matters related to the operation of the Website, as well as the provision of services specified in § 2 section 4 of the Regulations by the Foundation.
2. Complaints should be submitted electronically (to the Foundation’s email address indicated in § 1 section 7 of the Regulations, with the subject line “Complaint”) or in writing.
3. The Foundation will respond to the complaint within 30 days of its receipt.
4. A response to the complaint will be sent to the User to the email address indicated in the complaint or, if the complaint was submitted in writing, to the email address indicated in the letter or in writing to the address indicated in the letter. The Foundation is entitled to leave the complaint unanswered if the complaint does not include contact details for the User.
5. The Foundation informs that complaints regarding services provided electronically by third parties, access to which is related to the use of the Website by Users, are considered by these third parties in accordance with the principles and procedures specified in the regulations for the provision of services by these parties.
§ 5. Final Provisions
1. In the event of changes to services, the introduction of new functionalities to the Website, or the termination of the provision of services, the Foundation reserves the right to amend these Regulations.
2. Amendments to the Regulations will be published by the Foundation 7 days in advance before their effective date.
3. The Foundation has the right to discontinue any of the activities described in the Regulations at any time.
4. The Foundation reserves the right to disable the Website or limit the ability to post any content therein.
5. The invalidity of one of the provisions of the Regulations does not affect the validity of the remaining provisions.
6. The law applicable to the Regulations is Polish law.
7. Any disputes between the Foundation and the User arising in connection with the User’s use of the Website will be resolved amicably in the first instance. In the event of failure to reach an agreement, the court having jurisdiction to resolve disputes shall be the court having jurisdiction over the Foundation’s registered office.

9. The Regulations in their current wording are effective from 12 August 2022.
